General Terms and Conditions

Article 1: Introduction
1.1. These terms and conditions apply to all agreements within the meaning of the law that Casa Nobleza concludes with one or more persons.
1.2. These terms and conditions can apply to all services such as our culinary trips, our events, products, advice, coaching, accommodation, car rental, bus shuttles, dinners and wine tastings.
1.3. The customers/client has the right to cancel the agreement free of charge within 24 hours after the conclusion of the agreement, unless this right is excluded from the offer by using the term “final reservation”. In this context, customers/client only means the main booker/registrar. This has no right of withdrawal if the agreement is concluded within 8 weeks before departure.

Article 2: Information from Casa Nobleza on our trips
2.1. Before concluding the agreement, Casa Nobleza will announce when the cost must be (fully) paid. Casa Nobleza may require a deposit, the amount of which he will announce before the conclusion of the agreement.
2.2. For our organized trips, Casa Nobleza may require that the traveler take out travel insurance and may also require proof of this.
2.3. Casa Nobleza is not responsible for general information in photos, folders, advertisements, websites and other information carriers, if prepared or published by third parties.
2.4. If the offered trip is included in an (internet) publication by Casa Nobleza, the information stated here forms part of the agreement unless otherwise indicated.
2.5. At the latest when the agreement is concluded, the Casa Nobleza will provide information. The traveler is responsible for obtaining the necessary additional information from the relevant authorities with regard to passports and visa obligations and also to check in good time before departure that the previously obtained information has not changed in the meantime.
2.6. In the case of air transport, the identity of the operating airline will be announced to the traveler as soon as it is known to Casa Nobleza, at the latest when the travel documents are made available. The final departure and arrival times of transport components of the trip are listed in the trip shared.

Article 3: Information for travellers
3.1. The traveler provides all information about himself and the travelers registered by him that may be important for the conclusion or execution of the agreement in good time before the conclusion of the agreement. In any case, this includes his mobile phone number (s) and email address (es).
3.2. The traveler states details that may be important for the proper execution of the trip by Casa Nobleza about his/her own physical and mental condition as well as the capacity or composition of the group of travelers registered by him.
3.3. If the traveler fails to comply with his obligation to provide information, this may result in the traveler (s) being excluded from (further) participation in the trip by or on behalf of Casa Nobleza. In that case, all associated costs will be charged to the traveler.
3.4. The traveler can request Casa Nobleza to change the travel offer for both medical and other reasons. Casa Nobleza is not obliged to comply with such a request, but if it does so, the traveler is obliged to reimburse the costs associated with the change.

Article 4: Confirmation/revocation by Casa Nobleza
4.1. The agreement is concluded by the traveler's acceptance of Casa Nobleza's offer including the applicable terms and conditions. After conclusion of the agreement, the traveler will receive a confirmation and/or an invoice as soon as possible.
4.2. The trips offered on the website take place with a minimum of 4 participants. Casa Nobleza can terminate the travel agreement in writing if the number of registrations is smaller than the required minimum number of participants announced prior to booking. Casa Nobleza reserves the right to adjust the minimum number of participants up or down.
4.3. Casa Nobleza's offer is non-binding and can be revoked if necessary even after acceptance by the traveler of the offer and any confirmation by Casa Nobleza. Revocation due to correction of errors in the calculation of the travel sum or other errors is permitted. The withdrawal must be made as soon as possible, but in any case within 24 hours (traveling in Europe) or 48 hours (traveling to other destinations) after the date of acceptance, stating the reasons. If the traveler accepts the offer at the weekend, Casa Nobleza's withdrawal period commences at midnight on Sunday evening. In that case, the traveler is entitled to an immediate refund of any funds paid.
4.4. Obvious errors and/or mistakes are not binding on Casa Nobleza. From the perspective of the average traveller, such errors and mistakes are, or should be, recognisable as such at first glance.

Article 5: Changes by Casa Nobleza
5.1. Casa Nobleza can only change the travel agreement due to important circumstances that it informs the traveler without delay. The traveler can only reject the change if it causes him a disadvantage of more than minor importance.
5.2. Casa Nobleza can also change the travel agreement at an essential point due to important circumstances that it informs the traveler immediately, i.e. without any attributable delay on his part. The traveller can reject this change.
5.3. Casa Nobleza may increase the travel price up to twenty days before the start of the trip due to changes in transport costs (including fuel costs) or taxes and charges due. When applying this provision, Casa Nobleza will indicate how the increase was calculated. The traveller can reject the increase.
5.4. From the date on which the full travel sum must have been paid in accordance with the terms of Casa Nobleza and has actually been paid, it will no longer increase the travel sum - contrary to the provisions of paragraph 3.
5.5. In the event of a substantial change in the agreement, Casa Nobleza will immediately make an alternative offer to the traveler, if possible. The alternative offer must be equivalent. The equivalence of alternative accommodation must be assessed according to objective standards.
5.6. After a rejection as referred to in paragraphs 2 and 3, Casa Nobleza may terminate the travel agreement. The traveler is entitled to a refund or remission of the travel sum or a proportional part thereof if the trip has already been partially enjoyed. The traveler has the same right if he has rightly rejected a change that is more than minor to him.
5.7. A. If the cause of the change can be attributed to Casa Nobleza, the resulting damage suffered by the traveler will be borne by Casa Nobleza.
5.7. B. If the cause of the change can be attributed to the traveler, the resulting damage will be borne by the traveler C. If the cause of the change cannot be attributed to either the traveler or Casa Nobleza, the parties will each bear their own damage.
5.8 Casa Nobleza is obliged to inform the traveler about a change in the departure time. When it comes to the return trip of travelers who have booked for transport only and/or whose address of stay is unknown, Casa Nobleza will make reasonable efforts to inform them about this change.
5.9 Group travel transfers: In all cases where you book or extend your flight on your own or fly back with a different flight than that provided for in the group travel offer, the airport transfer is at your own expense. If the flight is booked by us on group dates, the collective transfer is included.
5.10 We reserve the right to change the accommodation presented without giving a reason. The newly offered accommodation will of course be comparable in terms of quality and comfort.
5.11 if, due to force majeure, such as a natural disaster or other important reason beyond Casa Nobleza's control, the trip cannot take place, Casa Nobleza is allowed to cancel the trip. The traveler can make use of the cancellation insurance to reimburse the costs.

Article 6: Help and assistance
6.1. Depending on the circumstances, Casa Nobleza is obliged to provide the traveler with help and assistance if the trip does not go according to the expectations that the traveler could reasonably have under the agreement. The resulting costs are borne by Casa Nobleza, if the shortcoming in the execution of the agreement is attributable to it.
6.2. If the cause is attributable to the traveler, Casa Nobleza is only obliged to provide help and assistance insofar as it can reasonably be expected of him. In that case, the costs are borne by the traveler.
6.3. If the trip does not go according to the expectations that the traveler could reasonably have under the agreement due to circumstances that are neither attributable to the traveler nor to Casa Nobleza, everyone bears their own damage. For Casa Nobleza, this includes the extra use of manpower; for the traveler, this includes additional accommodation and repatriation costs.

Article 7: Casa Nobleza's liability
7.1. The liability for damage suffered by the traveler is limited to three times the travel sum unless Casa Nobleza provides the service itself and/or if there is intent or deliberate recklessness on the part of Casa Nobleza. Casa Nobleza cannot exclude or limit its liability for damage caused by death or injury to the traveler.
7.2. A shortcoming in the fulfillment of an obligation that can be attributed to him also obliges Casa Nobleza to compensate for damage other than financial loss, insofar as that shortcoming has caused a loss of travel pleasure. This allowance amounts to a maximum of once the travel price.
7.3. If a service included in the travel agreement is subject to an EU treaty or regulation, Casa Nobleza may rely on an exclusion or limitation of liability that that treaty or Regulation grants or permits to a service provider as such.
7.4. Casa Nobleza is also not liable insofar as the traveler has been able to recover damage under insurance taken out by him, such as travel and/or cancellation insurance.

Article 8: Traveller's rights
8.1. In the plate theorem
8.1.1. The traveler can request the tour operator to be replaced by someone else. The following conditions apply to this: • The other person meets all the conditions attached to the agreement; and • The request is submitted no later than 7 calendar days before departure, or in such time that the necessary actions and formalities can still be carried out; and • The terms of the service providers involved in execution do not preclude this substitution. If the request cannot be granted, the tour operator will inform the traveler about this with reasons for dress.
8.1.2. The applicant, the traveler and the person replacing him are jointly and severally liable to the travel organizer for payment of the remaining part of the travel sum, the change costs and any additional costs as a result of the replacement.
8.2. Travel documents
8.2.1. In the confirmation, the travel organizer states at what time and how he will make the travel documents available to the traveler.
8.2.2. If the traveler has not received any travel documents at the time specified by the travel organizer, but no later than 5 working days before departure, he reports this to the travel organizer or booking office immediately.

Article 9: Cancellation by the traveler
9.1. The traveler can cancel the travel agreement. If he does so, he is obliged to compensate Casa Nobleza for the damage it suffers as a result of the cancellation. This amounts to a maximum of once the travel price.
9.2. Casa Nobleza can fix this damage at fixed percentages of the travel sum depending on the time of cancellation (cancellation costs).
9.3. The traveler who cancels the travel agreement is obliged to pay these cancellation costs, unless he makes it plausible that Casa Nobleza's damage has been lower. In that case, Casa Nobleza will charge for this lower damage. Damage includes loss suffered and lost profit.
9.4 Cancellation and change fees
Changes: an amount of €25 per change will be calculated, in addition to any amounts levied by hotels, tour operators or airlines. A change involves changing an existing booking and not a transfer to another tour where a cancellation fee may apply, which will be charged to you under our terms and conditions.
9.5 Cancelling
Should you, or a travel companion, be forced to cancel, a fee will be charged. Casa Nobleza charges €25, - administration costs plus the cancellation costs according to the Travel Conditions, which we provide you with an overview below. If the costs that our supplier charges to us exceed the overview below, we will pass on these additional costs to you. In case of cancellation, we always charge 25% of the travel sum.

In case of cancellation, there is no refund of unused parts of a program after departure.

Article 10: Payment
10.1. The traveler who has not fulfilled his financial obligations at the time specified by Casa Nobleza (article 2.1) is in default by operation of law.
10.2. If (timely) payment is not made, the traveler will be notified by or on behalf of Casa Nobleza and will be given a period of 14 days to still fulfil his obligations. If payment is still not made, the agreement is deemed to have been canceled as of this date. The fees already paid will be deducted from the cancellation fees.
10.3. The traveler who has not paid on time owes statutory interest on the amount due from the date of default. Furthermore, after a reminder, he is obliged to reimburse the extrajudicial collection costs of paragraph 4.
10.4. The extrajudicial costs amount to a maximum of 15% of a travel sum up to €2500; 10% over the subsequent €2500; 5% over the next €5000, - and 1% on the excess. Casa Nobleza may deviate from the above amounts and percentages for the benefit of the traveler.

Article 11: Traveller's obligations
11.1. The traveler is obliged to comply with all instructions given by or on behalf of Casa Nobleza and is liable for damage caused by his behavior. Judging this by the measure of the behavior of a correct traveler.
11.2. The traveler who causes or may cause such a nuisance or inconvenience that makes the proper execution of the trip difficult or may be hampered, can be excluded from (continuing) the trip by Casa Nobleza if Casa Nobleza cannot reasonably be expected to comply with the agreement. The resulting costs are borne by the traveler.
11.3. The traveler is obliged to avoid any damage and to limit it as much as possible.
11.4. Every traveler must verify the exact time of departure of the return trip no later than 24 hours before the specified time of departure.

Article 12: Complaints during the trip
12.1. Complaints about the implementation of the agreement must be reported on site as soon as possible so that a solution can be sought. To do so, the traveler must report — in this order — to: 1. the service provider concerned; 2. the tour guide or, if it is not present or accessible; 3. Casa Nobleza.
12.2. If the shortcoming is not remedied and impairs the quality of the trip, it must in any case be reported immediately, i.e. without any attributable delay, to Casa Nobleza in the Netherlands.
12.3. If a shortcoming is not resolved satisfactorily on site, Casa Nobleza provides the opportunity to have it registered in the form of a complaint (complaint report).
12.4. If the traveler has not complied with the reporting obligation and the registration of the complaint in the manner indicated by Casa Nobleza and the service provider or Casa Nobleza has therefore not been able to remedy the shortcoming, his possible right to compensation may (partially) lapse.

After the trip
12.5. If a complaint is not resolved satisfactorily, it must be submitted in the prescribed manner as soon as possible, but no later than two months after the end of the trip (or the service enjoyed) or after the original departure date if the trip has not taken place. If available, the traveler includes a copy of the complaint report.
12.6. If the complaint concerns the conclusion of an agreement, it must be submitted to Casa Nobleza as soon as possible, but no later than two months after the traveler becomes aware of the facts to which the complaint relates.
12.7. If the traveler does not submit the complaint in time, it will not be dealt with unless the traveler is reasonably blamed.
12.8. Casa Nobleza will provide a substantive response no later than one month after receiving the complaint. NB. For our cancellation policy, please refer to https://www.casanobleza.nl
